Terms of Use
These Terms of Use ("Terms") govern your use of the MessagePane Mac application ("the App") and the messagepane.app website ("the Site"). By downloading, installing, or using the App, or by accessing the Site, you agree to these Terms. If you do not agree, do not use the App or Site.
1. The App
MessagePane is a Mac application that allows you to open, view, print, save, and convert .eml and .msg email files on your own device. The App is distributed through the Apple Mac App Store and is subject to Apple's standard End User License Agreement (EULA) in addition to these Terms.
2. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices you own or control, solely for your personal or internal business purposes.
You may not:
- Copy, modify, or distribute the App or any portion of it.
- Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law.
- Rent, lease, lend, sell, or sublicense the App to any third party.
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
3. Acceptable use
You are responsible for the content of the email files you open with the App. You agree not to use the App to open, process, or distribute email files in a manner that violates any applicable laws, infringes any third-party rights, or facilitates fraud, harassment, or other harmful activity.
4. Optional network features
The App includes optional features — remote image loading and remote header verification — that may contact external servers when you choose to enable them. Your use of those features is your own choice and responsibility. We are not responsible for the content, availability, or privacy practices of any third-party servers contacted when you use these features. 5. The website and support form
When you contact us through the support form on this Site, you agree to provide accurate information and to use the form only for legitimate support inquiries. We reserve the right to decline or not respond to requests that are abusive, spam, or otherwise inappropriate.
The Site content is provided for informational purposes. We make reasonable efforts to keep it accurate and up to date, but we do not warrant that the Site is free from errors or that it will be uninterrupted.
6. Intellectual property
The App, Site, and all related content — including the name MessagePane, the app icon, design, and text — are the property of their respective owners and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials without our prior written permission.
7. Disclaimer of warranties
The App and Site are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your requirements, operate error-free, or be compatible with every email file format or macOS version.
Your use of the App to open or process email files is at your own risk. We strongly recommend maintaining backups of any important files before processing them with the App.
8. Limitation of liability
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the App or Site — including but not limited to loss of data, loss of profits, or corruption of files — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising under these Terms will not exceed the amount you paid for the App (if any) in the twelve months preceding the claim.
9. Third-party services and links
The App is distributed via the Apple Mac App Store; Apple's terms and policies govern that relationship. The Site uses Google reCAPTCHA and Google Fonts; Google's terms and policies govern those services. We are not responsible for the content or practices of any third-party services you interact with while using the App or Site.
10. Updates to the App
We may release updates, patches, or new versions of the App from time to time through the Mac App Store. Updates may change functionality, add or remove features, or address security issues. Continued use of the App after an update constitutes your acceptance of any revised Terms that accompany that update.
11. Termination
We may terminate or suspend your access to the Site or discontinue the App at any time, with or without notice, for any reason including if we believe you have violated these Terms. Upon termination, the license granted to you under Section 2 ceases immediately. Sections 6, 7, 8, and 12 survive termination.
12. Governing law
These Terms are governed by and construed in accordance with the laws of the United States. Any dispute arising under or relating to these Terms will be subject to the exclusive jurisdiction of the courts located in the United States, and you consent to personal jurisdiction in those courts.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the App or Site after updated Terms are posted constitutes your acceptance of the changes. If the changes are material, we will make reasonable efforts to notify users.
